Notes:
A Jacob J. Moomaw married Lucy Ann Hanks in 1857 in Pike County, Illinois. Lucy gave birth to two boys, namely Marion in 1860 and John in 1864, Jacob J. Moomaw, died in 1865 when Marion was 5 years old and his brother, John, was only 1 year old. Their mother, Lucy then married a man by the name of Marcus Murphy 2 years later in1867. In the 1870 census, Marcus and Lucy Murphy are now living in Beverly County, Illinois and the boys were incorrectly enumerated with the Murphy surname instead of ?Moomaw?. A common error for step children. Sometime in the 1870s, the family migrated from Illinois to Linn County, Missouri where Lucy died in 1878. About the same time, at age 19, Marion married a woman by the name of Mary McIntyre who already had a young son. In the 1880 census, Mary has now given birth to a girl who was simply called ?Baby? Moomaw, but they later named Sarah Elizabeth. The baby was 2 months old. John apparently had mental difficulties and he returned to Illinois to live with his grandparents and other family members when the 1880 census was taken. The boy?s maternal grandfather's Will listed both of their names and that John needed care since a conservator was named. So this is wjy a John Moomaw appears in Pitsfield, Pike County, Illinois.
The 1895 Will of Feldon/Fielden Hanks was provided by David C. Burns and is transcribed below. In the 1920 and 1930 census, John is living in the Pike Counmty, Illinois Alms house and the County Home. John never married and is buried in Pie County.
"
I Fielden Hanks of the county of Pike and state of Illinois declare this to be my last will and testament.
First - I give and bequeath to my daughter Lucilla York Lot number (1) one in block number fifteen (15) in the village of Milton in the county of Pike and state of Illinois. Also my buggy mare and buggy and harness and the milch cow now in her possession and seven hundred dollars in money.
Second - I give and bequeath to my son William Hanks five hundred dollars in money.
Third - I give and bequeath to my son George W Hanks the South half of the Northeast quarter of section number thirty-six (36) in Township number five (5) south of range number two (2) West of the fourth principal Meridian. Also all the land I now own in Detroit Township in section number thirty-one (31) being in all one hundred and seventy (170) acres more or less all in the county of Pike and state of Illinois. Also one bedstead and bedding, one parlor stove and one Jersey cow and five hundred dollars (500) in money. Provided however he shall pay to my grandson John Moomaw twenty-five dollars each and every year for five years.
Fourth - I give and bequeath to my grandson John Moomaw Lot number one (1) in block number sixteen (16) in the village of Milton in the county of Pike and state of Illinois. Also one bedstead and bedding and four hundred dollars in money. I further desire that my son George W Hanks be appointed Conservator for the said John Moomaw and the property and money put in his possession and expanded for the comfort and necessities of life of John Moomaw.
Fifth - I give and bequeath to my grandson Marion Moomaw the sum of five dollars.
Sixth - I give and bequeath to my grandson Gay Hoover five dollars in money.
Seventh - I give and bequeath to my grandsons William H Murphy and Edward E Murphy the sum of one dollar each.
Eighth - I desire that my executor sell my land located in section number five (5) in Township number six (6) south of Range number two (2) West of the fourth principal Meridian in the county of Pike and state of Illinois being fourteen acres more or less and apportion the money as stated above.
Ninth - I desire that after my Death and All funeral expenses and debts and all the payments of money as above stated that the net residue and remainder be given to my daughter Lucilla York.
Tenth - I hereby appoint C E Bolin sole executor of this will. I hereby revoking all former Wills by me made. In testimony whereof I have hereunto set my hand and seal this 30th day of September 1895.
